Terms of Service

1. Acceptance of Terms

By accessing or using the Polst platform, website, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The Service

Polst provides a sentiment layer that enables users to create A/B questions, distribute them across media channels, and collect trust-scored audience responses. Questions and aggregated results are indexed, searchable, and publicly accessible unless otherwise configured under an Enterprise plan.

We reserve the right to modify, suspend, or discontinue features of the Service at any time. Material changes will be communicated with reasonable notice.

3. Accounts and Access

You are responsible for maintaining the security of your account credentials. You agree to notify Polst immediately of any unauthorized access.

Enterprise accounts may include multiple seats, SSO integration, and role-based access controls. Access rights are governed by the applicable Enterprise service agreement.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or compromise platform integrity.

4. Content and Conduct

You retain ownership of the questions, images, and text you create on Polst. By publishing content on the platform, you grant Polst a non-exclusive, worldwide, royalty-free license to host, display, index, distribute, and cache that content as part of the Service.

You agree not to publish content that is unlawful, defamatory, harassing, misleading, or that infringes on the intellectual property rights of others.

You agree not to use the Service to manipulate results, generate artificial responses, impersonate others, or engage in any activity that undermines the trust and integrity of the platform.

Polst reserves the right to remove content that violates these terms and to take action against accounts responsible for violations.

5. Response Data and Trust Scoring

Responses submitted by participants are processed through Polst's trust-scoring system, which evaluates authenticity and filters bot activity, duplicates, and bad actors. Trust scores are applied algorithmically and are not guaranteed to be error-free.

Question creators receive aggregated response data through the Polst dashboard and, where applicable, through API feeds. Respondent personally identifiable information is not shared with question creators.

6. Intellectual Property

The Polst platform, brand, technology, trust-scoring algorithms, and all related intellectual property are owned by Polst Inc. Nothing in these terms grants you rights to Polst's trademarks, patents, or proprietary technology beyond the limited license to use the Service.

User-generated content remains the property of the user, subject to the license granted in Section 4.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. Polst does not guarantee uninterrupted access, error-free operation, or the accuracy of trust scores or aggregated data.

To the maximum extent permitted by law, Polst's total liability for any claim arising from your use of the Service shall not exceed the fees paid by you in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless Polst Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

9. Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration administered by JAMS, except where prohibited by law.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email and a prominent notice on the Polst website at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance.
